HMRC advises importers to appoint customs intermediary

Written by VAT IT Reclaim | May 9, 2021 10:00:00 PM

HMRC recommends that traders appoint a customs intermediary to manage customs paperwork on their behalf.

HMRC’s advice is no surprise. Customs procedures are complex, and companies that trade between the UK and EU previously did not have to worry about import VAT and customs duties. A professional intermediary can make the process faster and more efficient. No less importantly, expert assistance will ensure you avoid penalties and delays.

Claim zero tariffs when possible

The HMRC letter also urges businesses to check if they can claim tariff-free trade. Goods that originate in the EU can be imported into the UK without paying customs duties.

Delaying import declarations

The advice expands on the procedures for delaying import declarations. Delaying your import declaration provides a number of benefits. Notably, businesses have the opportunity to delay paying import VAT and duties.

The letter stresses that if you delay your import declaration, you are legally obliged to keep an accurate record of your imports. You must also make a supplemental declaration to HMRC 175 days of the goods arriving in the UK.

Penalties for noncompliance

The guidance contains a note of support: “We know that it is challenging getting used to new rules and we want to do everything we can to help and support you to get things right.”

However, HMRC is unambiguous about the consequences of noncompliance:  “If we find that you have deliberately missed the deadline for submitting your supplementary declaration you may have to pay a penalty of up to £2,500 and also lose the option of delaying future declarations.”
